Terms of Service

1. Acceptance of Terms

By accessing or using BrainPickle ("the Service"), operated by ClickClackLabs ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

BrainPickle is a trivia platform that provides daily challenges, topic-based quizzes, AI-generated quizzes, 1v1 challenges, group rooms, share cards, leaderboards, and related features. Some features require an account. Some features require a paid subscription. The Service may be installed as a progressive web app (PWA) on supported devices.

3. Accounts

You may sign in using Google OAuth or create an account with email and password. You are responsible for maintaining the security of your account and password. You must provide accurate information and keep it up to date. We reserve the right to suspend or terminate accounts that violate these terms.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or its infrastructure
• Scrape, crawl, or otherwise extract data from the Service in bulk
• Abuse the question reporting system or submit false reports
• Manipulate scores, leaderboards, or room results through automation or API abuse
• Impersonate other users in challenges or group rooms
• Use the AI quiz generator to produce offensive, harmful, or illegal content

5. AI-Generated Content

Quiz questions may be generated using artificial intelligence (Anthropic Claude). While we audit questions for accuracy, we do not guarantee that all questions or answers are correct. If you find an error, please use the in-app reporting feature.

6. User-Created Content

You may create quizzes using our manual quiz builder or AI quiz generator. You are solely responsible for the accuracy and appropriateness of content you create. You retain ownership of your original questions, but grant us a non-exclusive, royalty-free license to display, distribute, and make available your quizzes on the Service. We reserve the right to remove user-created content that violates these terms or is reported as inaccurate, inappropriate, or offensive.

7. Premium Subscriptions

Premium features are available via paid subscription. Payments are processed by Stripe. Subscriptions renew automatically unless cancelled. Refunds are handled on a case-by-case basis. We reserve the right to change pricing with reasonable notice.

8. Group Rooms

Group rooms allow multiple players to play the same quiz asynchronously. Rooms expire automatically after 24 hours. Display names you choose in rooms are visible to all participants. We reserve the right to remove rooms or players that violate these terms.

9. Email Communications

If you opt into streak reminders, you consent to receiving daily email notifications when your streak is at risk. You can disable these at any time from your account settings. We will not send marketing emails without your explicit consent.

10. Intellectual Property

All content, design, and code on BrainPickle are owned by ClickClackLabs or licensed to us. You may share your quiz results and share cards freely. You may not reproduce, distribute, or create derivative works from the Service itself.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

12. Limitation of Liability

To the maximum extent permitted by law, ClickClackLabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms. Material changes will be communicated via the Service or email.
