Terms of Service

1. Acceptance of Terms

By accessing or using the BrainPickle website, mobile apps, widgets, or integrations ("the Service"), operated by Click Clack Labs LLC ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

BrainPickle is a trivia platform: a daily quiz, topic quizzes in several languages, AI-generated and hand-built quizzes, 1v1 challenges, group rooms, leaderboards, streaks, share cards, and related features, on the web, as an installable web app, in the BrainPickle mobile apps, and through a Slack app and an Amazon Alexa skill. The Service is currently free, with no paid subscription. Features and availability can vary by platform or app version.

3. Accounts

You can browse without signing in and play as a guest where that option is available. Guest progress may be associated with a random account id and saved on your device. Sign-in is required for the mobile apps and certain features, including creating quizzes and adding friends. We try to carry guest progress into your signed-in account; clearing local storage or losing a guest session can make unlinked progress unrecoverable.

You are responsible for keeping account access secure and your details accurate. You must be at least 13 and meet any higher minimum age required where you live. If you are not old enough to enter a binding agreement, a parent or guardian must agree to these Terms for you. We may restrict accounts that violate these Terms. Our Privacy Policy explains how we handle account information and activity.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or its infrastructure
• Scrape, crawl, or otherwise extract data from the Service in bulk
• Abuse the question reporting system or submit false reports
• Manipulate scores, leaderboards, challenges, or room results through automation or API abuse
• Impersonate other users in challenges, group rooms, or leaderboards
• Use the AI quiz generator to produce offensive, harmful, or illegal content
• Circumvent rate limits, usage limits, or other restrictions
• Use the embeddable widget or APIs in a way that misrepresents BrainPickle or its content

5. AI-Generated Content

Quizzes may be generated with artificial intelligence or written by users. Source links are provided where available, but do not guarantee that a question, explanation, or translation is correct or current. Trivia is for entertainment and learning and should not be relied on for professional advice. Use the report action to flag an issue; we may correct, quarantine, or remove content and adjust affected results.

6. User-Created Content

You may create quizzes using the AI quiz generator or manual quiz builder. You are solely responsible for the accuracy and appropriateness of content you create. You retain ownership of your original questions, but grant us a non-exclusive, royalty-free, worldwide license to display, distribute, and make available your quizzes on the Service. We reserve the right to remove user-created content that violates these terms or is reported as inaccurate, inappropriate, or offensive. If you delete your account, your quizzes will be anonymized (your name removed) but may remain available on the Service.

7. Friends, Leagues, and Shared Games

Challenges allow you to compete 1v1 with another player on the same quiz. Your display name, score, and time are shared with your opponent when the challenge is completed. Challenge links are publicly shareable.

Friends can compare the progress shown in the friends experience, including weekly correct-answer totals and Daily results. Weekly leagues rank eligible correct answers from completed rounds under the rules shown in the Service. Scores, promotions, streaks, and milestones have no cash value and are not a promise of a prize. We may correct errors or remove scores obtained through abuse.

Group rooms allow multiple players to play the same quiz asynchronously. Rooms expire automatically after 24 hours. Display names you choose in rooms are visible to all participants. We reserve the right to remove rooms or players that violate these terms.

8. Pricing

The Service is free. There is no paid tier, no subscription, and no trial; we do not collect payment details and we do not charge for any feature. The Service is currently offered without ads on the website and current mobile releases; older app versions may contain advertising as described in the Privacy Policy. If we introduce a paid offering, we will explain the price and terms before any purchase. We will not charge you simply because you already have an account.

9. Usage Limits

Because AI quiz generation has a real cost to run, accounts are subject to a daily limit on generations (currently 5 per day), and requests are rate limited to prevent abuse. These limits apply to every account and may change at our discretion. There is no way to pay to raise them.

10. Email and Notifications

Signing in does not automatically subscribe a new account to recurring Daily emails, streak reminders, weekly digests, or product updates. Choose these in account settings; existing preferences remain as you set them. Challenge and requested-topic notices have separate settings. Engagement emails include an unsubscribe option. We may still send essential messages, such as a sign-in code you request or a security notice.

Push notifications require your device or browser permission. Declining that permission does not prevent play; notification settings remain available if you change your mind. You can change delivery preferences in BrainPickle and permission in device or browser settings. A message already being delivered may still arrive after a preference changes.

11. Embeddable Widget and APIs

We provide an embeddable widget that allows third-party websites to display BrainPickle quizzes. By embedding our widget, you agree not to modify its appearance or behavior, remove attribution, or use it on sites that contain illegal, offensive, or misleading content. We reserve the right to disable widget access at any time.

12. Third-Party Platform Integrations

BrainPickle is available as integrations on third-party platforms, including Slack and Amazon Alexa. By using these integrations, you agree to both these Terms and the terms of the respective platform.

Slack: When you install the BrainPickle Slack app, we store your workspace ID, channel configuration, and bot access token to deliver trivia questions and track leaderboard scores. Slack user IDs and display names are stored to attribute answers and display leaderboards. When the app is uninstalled from a workspace, all associated data (workspace configuration, trivia posts, answers, scores, and quiz sessions) is permanently deleted.

Amazon Alexa: The BrainPickle Alexa skill does not store any personally identifiable information. Quiz sessions are maintained in temporary Alexa session attributes and are discarded when the session ends. No Alexa user IDs or voice data are stored on our servers.

13. Question Reporting and Moderation

You may report questions you believe are incorrect, ambiguous, outdated, or inappropriate. Reports are reviewed and questions may be quarantined or removed. Abuse of the reporting system (e.g. false or frivolous reports) may result in account suspension.

14. Account Deletion

You can delete your account at any time from your account page or the account deletion page. Your personal data (profile, quiz results, streaks, email and push preferences) is permanently deleted within 30 days. Quizzes you created and reports you filed are kept with your name removed. Challenge and room records have your user id removed.

15. Intellectual Property

All content, design, and code on BrainPickle are owned by Click Clack Labs LLC or licensed to us. You may share your quiz results and share cards freely. You may not reproduce, distribute, or create derivative works from the Service itself without our written permission.

16. Disclaimer of Warranties

To the extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not guarantee the accuracy of any quiz question or answer.

17. Limitation of Liability

To the maximum extent permitted by law, Click Clack Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from or relating to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater. These exclusions and limits do not apply where prohibited by law and do not exclude liability for fraud, intentional misconduct, or any other liability that cannot lawfully be excluded.

18. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Click Clack Labs LLC and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your user-created content.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in New York, except where applicable consumer law gives you mandatory rights to another law or court. Nothing in these Terms waives those rights.

20. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms. Material changes will be communicated via the Service or email before they take effect where required by law. Changes do not remove rights you already have under mandatory consumer law.
